Before signing a tenancy agreement, establish the legal framework, the total cost and how you can leave. A familiar template can contain outdated or inappropriate terms. I would compare the written agreement with the advertised property, agreed rent and actual occupants, then resolve contradictions before paying. This guide concerns ordinary private renting; lodgers, halls and social tenancies can have different rules.
England’s relevant private tenancies became assured periodic tenancies from May 2026; an old assured-shorthold fixed-term template should not be accepted without checking. Scotland’s private residential tenancy is normally open-ended too, but under different law. Wales uses occupation contracts, including fixed-term and periodic forms. Northern Ireland has its own private-tenancy rules. One country’s notice period should not be copied into another’s paperwork.
Check the full address, included rooms, parking, storage and any shared areas. Identify the landlord and agent, repair contact and address for formal notices. Belfast Record is not proof of authority to let the home. Check registration or licensing where applicable, and do not transfer money solely because someone has supplied attractive photographs and an unsigned sample agreement.
Ensure every proposed tenant is named correctly and understand whether liability is joint and several. That can mean responsibility for more than a personal share if another tenant does not pay. Guarantors should read the separate guarantee, including its duration and financial scope. A casual agreement between flatmates does not automatically limit what the landlord can recover under the contract.
Confirm the amount, frequency, payment date, included bills and permitted increase process. Four-weekly rent is not the same as calendar-monthly rent. For covered English tenancies, landlords cannot take rent before signing and can normally request no more than one month in advance afterwards. Do not extend that rule to every UK arrangement. Challenge unexplained fees using the relevant nation’s rules before agreeing.
Ask what each payment secures, when it is refundable and whether it is credited towards rent or the security deposit. Birmingham Focus is not a receipt or protection certificate. In Scotland, non-refundable holding deposits and fees for starting a tenancy are unlawful. A security deposit has separate protection requirements; obtain the scheme information and retain proof of payment rather than accepting a vague promise to register it later.
Read the correct statutory and contractual exit requirements, not merely a heading called “break clause”. An English assured periodic tenant generally gives two months’ written notice under the current rules. A Scottish private residential tenant normally gives twenty-eight days; joint tenants must act together to end that tenancy. Welsh fixed-term and periodic occupation contracts have different exit arrangements, so obtain advice if uncertain.
Ask what happens if one person wants to leave but others stay, or if an assignment or replacement is proposed. A landlord’s informal agreement to consider someone new is not a completed release from liability. Keep written confirmation of any agreed variation and the effective date, particularly where deposits and guarantors are involved.
Identify rules on pets, guests, subletting, working from home and alterations, while recognising that statutory rights can override unfair terms. The separate Leeds Angle link is not permission from the landlord. Establish notice and emergency access arrangements, reporting procedures and responsibility for included appliances. A clause should not be treated as transferring every legal repair duty to the tenant merely because it appears in print.
Record any promised repair, completion date and responsible contact in writing, rather than leaving the agreed condition dependent on memory.
Inspect the inventory, photograph existing damage and record meter readings and keys. Ask about relevant safety records and unresolved repairs before occupation. Correct an inaccurate inventory promptly through a dated written record. Keep the signed agreement, required information, receipts and agreed changes together. Sign when the home, costs, responsibilities and realistic exit route are understandable, rather than because a deadline makes unanswered questions feel inconvenient.
